Appeals
The student or registered organization being disciplined may appeal a decision reached by a judicial council, board, or administrative hearing. A request for an appeal must be made in writing to the Dean of Students within a period of 10 days from the date of notification. An appeal made to the Dean of Students must be based on one or more of the following reasons:
- Due process rights were violated;
- The sanction received was arbitrarily harsh or capricious; or
- New evidence became available.
The individual or organization being disciplined must specify in detail why they believe they are entitled to an appeal. Simply restating the reasons listed above is not sufficient justification for an appeal. The appeal, if granted, will be heard by the Administrative Appeal Officer or may be assigned to the Judicial Appeals Board by the Dean of Students. If the appeal is denied, a second appeal may be made to the Vice President for Student Affairs, who will review the documentation relative to the decision in order to determine whether the disciplinary procedures of the university were followed, or whether the decision was arbitrary or capricious. If, after reviewing the record, the Vice President for Student Affairs determines that the procedures have been followed and the decision was not arbitrary or capricious, the appeal will be disallowed. All sanctions shall remain in effect throughout the appeal process.
